Thread :

What is my status when I-20 expires and OPT file still pending?
Hi All,
I have a question regarding filing I-485 and I appreciate if anyone would help me.

I Filed for EB2-NIW (non-concurrent) in December 2013 . At that time I was on H1-B VISA and waiting for my change of status to F-1 (Student). My I-140 just got approved , but here is my situation. Since I have applied for OPT for Oct.1 2014, my I-20 will expire on Sept. 30,2014. My OPT is still pending and I do not think I will have it by Oct. 1, 2014.

I will do my best to file the I-485 before my I-20 expires. but my question is , in case I file I-485 after Sept.30 (while my I-20 has expired but my OPT is pending) , what will be my status ? What should I write in the forms I-485 and 765 as my Current status, job and expiration?
On a separate note , do you think the fact that my job title and VISA status has changed between filing I-140 and 485 will affect my application , considering that this is a self-petitioned , non-employment based application ?

I really appreciate your help ,

You should have a new I20 with new dates for ur OPT. ur DSO should have given it to you and its copy is required to be sent with the OPT application.

Do u have that I20? The end date on that I20 will be the date u requested as OPT end date.

You are allowed a max of 60 days between ur graduation and OPT (you are considered on F1). So you are good for now till ur OPT results.
